DPDP Act 2023 and DPDP Rules 2025
India’s Digital Personal Data Protection Act applies to the personal data you collect through forms, WhatsApp, email and ads. The DPDP Rules 2025 roll obligations in by phases, with most duties for businesses applying from 13 May 2027 and consent-manager provisions from 13 November 2026.
What this means for your marketing
- Collect clear, specific consent on lead forms; no pre-ticked boxes.
- Explain why you collect data and how people can withdraw consent.
- Do not buy or use scraped phone or email lists.
- Delete data you no longer need and keep it secure.
Penalties
The Act allows penalties of up to ₹250 crore per breach for failures such as not protecting data. Building consent in now is far cheaper than fixing it later.
TRAI DLT for SMS
Commercial SMS in India must be sent through a DLT-registered sender ID and approved templates. Email and WhatsApp do not use DLT, but WhatsApp requires opt-in and approved templates for business-initiated messages.
