RERA-First Marketing: The Compliance Rules Every Agent Must Follow
Most marketing guides skip this part. In India, an unregistered agent or a non-compliant ad can cost far more than any campaign earns. Here is what the law and state regulators expect in 2026.

This section summarises the Real Estate (Regulation and Development) Act, 2016 and state orders for marketing purposes. It is not legal advice. Rules and fees differ by state, so always check your state RERA website before you publish.
1. Register as an agent before you advertise
Under Section 9 of the RERA Act, anyone who facilitates the sale or purchase of units in a registered project must register as a real estate agent with the state authority. You receive one registration number per state, and you quote it in every sale you facilitate.
Under Section 62, an agent who breaches Sections 9 or 10 can be fined ₹10,000 for every day the default continues, up to 5% of the cost of the plot, apartment or building whose sale was facilitated.
Example: agent registration in Telangana (TG-RERA)
In Telangana, the agent registration fee is ₹10,000 for individuals and ₹50,000 for firms, and registration is valid for five years. TG-RERA also states that advertisements for apartments in a registered project must carry the TG-RERA registration number.
2. Put the right numbers on every ad

Maharashtra: the QR code and top-right rule (MahaRERA Order 46C/2025)
MahaRERA’s order dated 8 April 2025 requires promoters and registered agents to show the project’s MahaRERA registration number, the MahaRERA website and the project QR code in all advertisements, including Reels, posts, hoardings and flyers. The details must sit in the top-right quadrant, in a font at least as large as the contact details, in contrasting colours, and the QR code must be scannable. Penalties range from ₹10,000 to ₹50,000 per non-compliant advertisement.

Build a fixed RERA strip into your Canva or CapCut templates (top-right: project RERA number, agent RERA number, website, QR code). Then no creative can go live without it.
3. Never promote an unregistered project
Section 10 bars agents from facilitating the sale of units in a project that should be registered but isn’t. “Pre-launch” and “soft launch” campaigns for projects without RERA registration are the most common trap. If the project isn’t registered, don’t run ads, don’t collect expressions of interest, and don’t post it on portals.

5. Handle lead data lawfully (DPDP Act 2023 + Rules 2025)
Every enquiry form, lead ad and WhatsApp chat collects personal data. The Digital Personal Data Protection Rules were notified in November 2025 with an 18-month phased rollout. The consent-manager framework starts on 13 November 2026, and full obligations (notice, consent, security, data-principal rights) apply from 13 May 2027. Penalties can reach ₹250 crore.

6. Meta's Housing category: India vs NRI campaigns
At the time of writing, campaigns targeting audiences inside India generally don’t need Meta’s Housing Special Ad Category. Campaigns aimed at NRIs in the US or Canada do. That category removes age, gender and postcode targeting and uses a minimum radius, so plan broader audiences and stronger creatives for NRI launches. 2. Your own website with hyperlocal SEO
Portals rank for “flats in Hyderabad”. You can rank for the long tail they cover poorly: “resale 3 BHK in Manikonda gated community”, “rental flats near Wipro circle for families”, “open plots in Adibatla HMDA approved”.
Build one page per locality you serve
Each locality page should include current listings, a price range table with the month updated, commute times, schools and hospitals, upcoming infrastructure (with sources), your deals closed there, reviews from clients in that locality, and a WhatsApp button.

Portal leads vs your own leads
Portal leads are fast but shared and price-sensitive. Your own leads (website, Google profile, Meta to WhatsApp) cost effort to build but are exclusive. Track both, and move budget each quarter to whichever gives the lower cost per site visit.
4. Meta ads (Facebook and Instagram)
